Why Caribbean Is a Rental Market

Most mainland US timeshare owners use their weeks themselves. In the Caribbean, the economics shift: many owners buy specifically to rent. Here is why:

Deeded vs. Right-to-Use by Location

Ownership structure varies by jurisdiction, and this matters significantly for Caribbean purchases:

For buyers, deeded ownership is generally preferred because it conveys real property rights that survive the developer. RTU contracts expire, and when they do, your ownership ends regardless of what you paid. Always check the remaining term on any RTU resale.

Mexico: Special Legal Considerations

Buying a timeshare in Mexico involves unique legal requirements that do not apply in the US or US territories:

Fideicomiso (Bank Trust)

Mexican law prohibits foreigners from directly owning property within 50 km of the coast (the "restricted zone" — which includes every major resort destination). To work around this, foreign buyers use a fideicomiso — a bank trust where a Mexican bank holds legal title and you hold beneficial ownership. The trust typically runs 50 years and is renewable. There is an annual trust fee of approximately $500-$800.

PROFECO Consumer Protection

PROFECO (Procuraduria Federal del Consumidor) is Mexico's consumer protection agency. They handle timeshare complaints and can mediate disputes. However, enforcement is slower and less predictable than US consumer protection agencies.

5-Day Rescission Period

Mexican law provides a 5 business-day rescission period for timeshare purchases. This is shorter than Florida's 10-day period. If you buy from a developer at a presentation in Cancun, you have 5 business days to cancel without penalty. Get the cancellation terms in writing at the time of purchase.

Mexico Purchase Risks

Mexico timeshare fraud is well-documented. Never wire money to a company you have not independently verified. Get the fideicomiso details before committing. Use a US-based escrow company if possible.
